Expert Available: Costco Sues Trump Admin Over Tariff Refunds

As President Donald Trump and his administration continue to impose sweeping tariffs, Fortune 100 company Costco Wholesale Corporation has joined the growing list of companies suing the Trump administration to ensure they are eligible for tariff refunds if the Supreme Court rejects the administration’s tariff policies.

Following the filing of the lawsuit, Cato scholar Brent Skorup released the following statement:

At oral argument in the tariffs case last month, most Supreme Court justices appeared wary of deferring to the president when he ‘discovers’ new, emergency tariff powers hidden in an old statute. If the court rejects the Trump administration’s novel reading of the International Emergency Economic Powers Act (IEEPA), it may also rule that businesses are entitled to refunds for the tariffs they have paid this year.

t’s uncertain whether refunds will be granted and, if so, how much. But the possibility has prompted many companies — including Costco — to file actions in the U.S. Court of International Trade to get in line, so to speak, for potential refunds.

Refunds or not, we are hopeful the Court will once again reject — just as it did several times during the Biden administration — presidential attempts to stretch ambiguous statutory language beyond what Congress authorized.
